Background and General Information

Under Section 156.104, of the Texas Finance Code, the Mortgage Industry Advisory Committee was created and is authorized to advise and assist the Texas Department of Savings and Mortgage Lending Commissioner “Commissioner” on issues such as proposing and adopting rules related to licensing, conduct and ethics, forms, interpretations, and enforcement. Record votes are taken, by the Committee, in regards to these rules.

The Committee is comprised of six members appointed by the Commissioner. The members must be licensed by the Department as residential mortgage loan originators, two of whom must hold an active real estate broker or salesperson license issued by the Texas Real Estate Commission. In addition to being licensed by the Department, each member must be actively engaged in the business of originating, brokering, or funding residential mortgage loans at the time of appointment, and primarily engaged in the business of originating, brokering, or funding residential mortgage loans for at least two years before the member's appointment.

Criteria for consideration to be a member may include, but are not limited to:

  • No consumer complaints resulting in adverse findings or fault of the candidate.
  • Satisfactory examination/inspection rating.
  • No adverse personal or professional reputational concerns exist.
  • Excellent reference checks, both submitted and randomly conducted
    by the Commissioner.
  • Desire and ability to clearly represent the mortgage broker industry as a whole,
    and not special interests or personal agendas.
  • Desire and ability to serve as ambassador for both the agency and the industry
    in all respects.
  • Ability to clearly and concisely communicate and is open to any/all suggestions
    and deals in good faith at all times.

To be a Committee member, a candidate must meet the statutory qualifications and be nominated by a state trade association related to the mortgage industry. The Commissioner conducts interviews with the candidates and appoints the members.

Appointments are made without regard to sex, race, color, age, disability, religion or national origin. Members serve staggered three-year terms, with two terms expiring February 1st of each year. A member whose term is expiring may, upon the request of the Commissioner and the willingness of the member, serve a second term.

The Commissioner may remove a member if the member does not maintain the required qualifications or cannot discharge the member’s duties. In the event of a vacancy during a term, the Commissioner shall fill the position for the unexpired part of the term with a person who meets the qualifications of the position.

The Committee is required to meet at least two times per year, but may meet more frequently as the need arises.

Meeting Schedule
